Back in 2002, a decision was made on the work of tow trucks in the capital, however, in 2005, the Shevchenkovsky District Court declared illegal the decision of the Kyiv City Council No 47/207 dated 26.09.2002 on the use of forced evacuation of vehicles whose drivers violated the rules of stopping and parking. On December 9, 2005, the Court of Appeal of Kyiv, having considered the appeal of the Kyiv City Council dated 30.08.2005 on the legality of the decision of the Shevchenkovsky District Court, left it in force.
Despite this, I firmly decided to return the tow trucks to the streets of the capital.
Tow trucks are not a personal whim of the mayor of Kyiv, but just one of the ways to release the streets of the capital from congestion. The impudence of unscrupulous drivers should be punished. And the imprudent decision to ban tow trucks has already shown how city roads have become overloaded with cars left uncontrollably on the side of the road.
Gross income from the work of tow trucks was about 1 million hryvnia per month. But the main thing for us was not to attract additional revenues to the budget, but to put things in order on the roads, to discipline drivers who illegally park their cars where it was convenient for them, preventing the passage of other cars of utility service, ambulances or firefighters.
So, on May 16, 2006, the Supreme Administrative Court of Ukraine made a decision, which allowed the loading of illegally parked cars in Kyiv onto tow trucks and carrying them to the penalty area. But one year later, according to the decision of the Shevchenkovsky District Court of the capital of March 6, 2007, the Kyiv City Council was obliged to cancel the tow trucks, and any evacuation of the vehicle was considered illegal. In April 2007, the Kyiv Court of Appeal recognized the work of the capital's evacuators as legal. On December 18, 2007, the Main Department of Transport of the KSCA, together with the Main Department of the Ministry of Internal Affairs of Ukraine, prepared an order No 83/167 “On the procedure for applying measures of influence to drivers who violated the Traffic Laws and the Rules regarding landscaping, parking vehicles, silence in public places, trade established in the city of Kyiv in the markets in the city of Kyiv”. But the Ministry of Justice of Ukraine canceled it on March 11, 2008.
Since July 2008, the work of tow trucks has been restored. This is a common practice in Europe to combat those who illegally park cars at public transport stops, at pedestrian crossings, on sidewalks, etc.
However, they soon left the streets again ...
